DSL Network Access Agreement
for off-campus UW students, faculty, staff and retirees

UW is no longer offering Qwest DSL service.

UW Information Technology and Qwest have partnered to provide high-speed access to the campus network and the Internet for off-campus UW students, faculty, staff and retirees. The service is provided through Qwest’s residential DSL service. 

Qwest DSL service provides 256 Kbps access over many standard home telephone lines. For more information see the UW DSL Information Web page (www.uwyo.edu/infotech/services/data/dsl.htm).

There is a monthly charge from Qwest for DSL services. There is also a one-time activation fee and a DSL modem must be purchased from Qwest. Qwest offers DSL modem installation for a one-time fee. The latest fee schedule and promotions from Qwest can be found at http://www.qwest.com/dsl/. In addition to the Qwest charges, there is a UW charge of $10 a month. Because of the high-speed nature of Qwest DSL service, not all home telephone circuits are suitable for the service. The Qwest DSL Ordering Form for the undersigned customer is specific to this contract and for purposes of this contract will be referred to as Qwest DSL Order Form (www.uwyo.edu/infotech/services/data/dslorderform.htm).

Definitions and Service Description

The University of Wyoming Data Network (called hereafter NETWORK) is the data communications network operated by the University of Wyoming Division of Information Technology for the students, faculty, staff and retirees of the University of Wyoming. The network provides for data exchange between computer systems connected to the UW network and provides access to computers and systems worldwide via links to the Internet. For purposes of this document students, faculty, staff and retirees whose home computers are connected to the NETWORK by this service are referred to as SUBSCRIBER(s).

Support and Responsibilities

Information Technology will verify that the SUBSCRIBER(s) telephone circuit is suitable for DSL service and will order the DSL connection from Qwest.

Qwest will provide the network equipment for the SUBSCRIBER(s) residence. The SUBSCRIBER(s) are responsible for the installation of the network equipment and all cabling at their residence. Qwest can provide installation and configuration of the modem, and network support, for a fee. It is strongly recommended that UW DSL subscribers contract for a Qwest technician to provide the installation service. Because University monthly charges are low and cover only basic costs, modem installation and configuration is NOT available from Information Technology.

The SUBSCRIBER is responsible for ensuring that any use does not adversely affect the operation of the NETWORK. Use of the NETWORK for entertainment purposes (such as the transfer of video or audio files) may be limited or restricted by the University. Some Qwest ISP partners may not limit or restrict transfers. A list of Qwest ISP partners for DSL service in Laramie can be found at http://www.qwest.com/residential/internet/isp_list.html#WY.

Each SUBSCRIBER(s) will be responsible for ALL computer hardware and software on computers that are connected to the network. UW computer consultants are only available for questions regarding UW standard applications including email configurations, browsers, Microsoft Office, and specific UW software. Consultants are not available to assist with DSL modem configuration. Consultants are available by phone (766-help) Monday through Friday 8:00am to 5:00pm (7:30 am to 4:30 pm during the summer) or via email (userhelp@uwyo.edu).

The SUBSCRIBER is responsible for contacting Information Technology Business Office when they wish the NETWORK service terminated. Information Technology will terminate the subscriber's access to the NETWORK when the subscriber ceases their student, faculty or staff association with the University. The subscriber is responsible for contacting Qwest to terminate DSL service or to switch to another Internet Service Provider (ISP). Each subscriber will continue to be billed by UW until Qwest has informed the University that the service has been terminated or changed.

Requirements and Fees

UW will charge a monthly fee of $10.00 for a 256 or 640 Kbps connection. This is in ADDITION to any fees charged by Qwest. It will be billed separately by UW.

Unpaid Bills

Unpaid bills are subject to University employee & student account policies. Employee policies include, but are not limited to the withholding of wages from payroll checks. Student policies include, but are not limited to: the withholding of housing deposits, transcripts & diplomas. Failure to pay your bill may result in assessment of collection costs, including collection agency costs, court costs & attorney fees. Returned checks will result in a fine according to University policy.

Service Effective Date and Term of Agreement

Network access is a function of Qwest's service installation scheduling and will normally be available to a SUBSCRIBER within five working days after a contract is signed.

Limitation of Liability

  • Information Technology makes no warranties or representations, either express or implied, regarding the service in this agreement and disclaims any implied warranty of merchantability and that the service provided pursuant to this agreement will be fit for a customer's particular purpose. In particular, Information Technology does not guarantee uninterrupted working of the network service or any telecommunications equipment purchased from Information Technology in connection with this service. Compensation for damages shall not exceed cost of connection.
  • In no event shall Information Technology, University of Wyoming, its suppliers, or the technicians working on the network be liable, personally or otherwise, for any other damages whatsoever (including without limitation: damages to the subscriber’s computer, damages for financial loss, research or academic interruption, loss of academic information or other pecuniary or punitive loss) arising out of the use of or inability to use the service provided by Information Technology under this agreement, even if Information Technology has been advised of the possibility of such damages.
  • The SUBSCRIBER shall indemnify, hold harmless and defend Information Technology, and UW, its Board of Trustees, directors, officers, employees, faculty, staff and agents against all claims (including all legal fees and disbursements), actions, or proceedings including any damages, consequential or otherwise, arising from this Agreement.

Conditions

Access to the NETWORK is granted based on University Regulations (UniRegs, including UniReg 690), local state and federal laws, and Internet acceptable use policies. By signing for this service, the Subscriber agrees to the regulations and policies specified above.

UW STANDARD ADDENDA

Sovereign Immunity
The University of Wyoming does not waive its sovereign immunity or its governmental immunity by entering into this Agreement and fully retains all immunities and defenses provided by law with regard to any action based on this Agreement.

Governmental Claims
Any actions or claims against the University under this Agreement must be in accordance with and are controlled by the Wyoming Governmental Claims Act, W.S. 1-39-101 et seq. (1977) as amended.

Interpretation
The parties hereto agree that (I) the laws of Wyoming shall govern this Agreement, and (ii) any questions arising hereunder shall be construed according to such laws, (iii) this Agreement has been negotiated and executed in the State of Wyoming and is enforceable in the courts of Wyoming.
