Procedures for Completing I-9 Form

Note:  These training materials are intended as guidelines for UW staff to follow in processing personnel transactions and are not designed or intended for public use.  Government regulations take precedence if there is any discrepancy between the information presented here.

I. Policy

The University of Wyoming's Compliance:

The Immigration Reform and Control Act of 1986 makes it unlawful for the University to hire, or to recruit or refer for a fee, either an alien knowing the alien is unauthorized to work or an individual who has not complied with the law's verification requirements.  Therefore, all persons hired after November 6, 1986 must produce for examination certain specified documents that evidence both their authorization for employment in the United States and establish their identity.

Upon hiring a Benefited and/or non-Benefited employee, federal law (Immigration Reform and Control Act of 1986) states the I-9's must be completed within the first 3 days of employment.  However, UW Information Circular #1987-5 states that an I-9 needs to be completed prior to employment. 

Recently President Clinton signed an Executive Order that allows federal funding to be pulled from institutions which violate the Immigration Act.  Since UW receives an abundance of federal funding and would be at risk of losing its funding because of such violations, please have the authorized person in your office complete the I-9, or send your new hire to our department with proper documentation to fill out the I-9 form prior to starting work. 

Penalties for Failing to Comply:

Failure to comply with this regulation places the University in violation of IRCA.   A department with such violations puts the University at risk of possible non-compliance penalty and/or fine.  This fine could be passed on to the department and/or the supervisor, who allowed the employee to work prior to authorization.   Failure to comply may also cause the new hire a delay in pay.  If you have any questions regarding the I-9 regulation/process, please contact the Human Resources Department, 766-2215.  We are located in Wyoming Hall, Room 139.

After completing Section 1, please bring the I-9 to your department representative or to Human Resources Department located in Wyoming Hall, Room 139 so that Section 2 may be completed.
